Catholic opponents of abortion and embryonic stem cell research usually base their position on a hylomorphic account of ensoulment at fertilization. They maintain that we each started out as one-cell ensouled organisms. Critics of this position argue that it is plagued by a number of intractable problems due to fission (twinning) and fusion. We're unconvinced that such objections to early ensoulment provide any reason to doubt the coherence of the hylomorphic account. Earl Conee has argued that the metaphysics of personal identity is irrelevant to the morality of abortion. He claims that doing all the substantial work in abortion arguments are moral principles and they garner no support from rival metaphysics theories. Conee argues that not only can both immaterialist and materialist theories of the self posit our origins at fertilization, but positing such a beginning doesn’t even have any significant impact on the permissibility of abortion. We argue that this thesis is (...) wrong on both accounts. We do so, in part, by relying on a hylomorphic rather than a Cartesian conception of the soul. There are good reasons for believing such a soul theory can favor an earlier origin than the leading materialist accounts. We also show that the theological metaphysics of hylomorphism provide greater support for a pro-life position than the Cartesian position Conee discusses. However, we argue that even on a materialistic account of personal identity, metaphysics has substantial bearing upon the morality of early abortions. (shrink)

From fertilization to approximately the sixteenth day of development, human embryonic cells are said to have the capacities of totipotency and monozygotic twinning, both of which are problematic to a theory of ensoulment at fertilization. In this article I will address the problems which these capacities pose to such a theory and present an interpretation of the biological data which renders ensoulment at fertilization more plausible. I will then argue that not only is an ensoulment theory consistent with current biological (...) data on the human embryo, but it may offer an explanation for the phenomencon of monozygotic twinning. Our contention is that all of the major arguments for abortion are also arguments for permitting infanticide. One cannot distinguish the fetus from the infant in terms of a morally significant intrinsic property, nor are they morally discernible in terms of standing in different relationships to others. The logic of our position is that if such arguments justify abortion, then they also justify infanticide. If we are right that infanticide is not justified, then such arguments will fail to justify abortion. (...) We respond to those philosophers who accept infanticide by putting forth a novel account of how the mindless can be wronged which serves to distinguish morally significant potential from morally irrelevant potential. This allows our account to avoid the standard objection that many entities possess a potential for personhood which we are intuitively under no obligation to further or protect. (shrink)

The potential for healthy development is the key to determining the moral status of mindless and minimally minded organisms. It even provides the basis for a defense of speciesism. Mindless and minimally minded human beings have interests in the healthy development of sophisticated mental capacities, which explains why they are greatly harmed when death, disease, and other events frustrate those interests. Since the healthy development of members of non-human species doesn’t produce the same sophisticated mental capacities, mindless and minimally minded (...) non-human beings lack the interests of mindless and minimally minded human beings. The absence of such interests in developing valuable mental capabilities means non-humans can’t be benefited and harmed to the same degree as human beings. This results in mindless and minimally minded non-humans having lower moral status than human beings. This doesn’t mean that any member of our species is more valuable than any other member of any other possible species. We instead claim that human beings with undeveloped or impaired minds have greater moral status than any member of any other known species that has manifested equivalent mental capacities. (shrink)

This paper presents an account of how human spontaneous embryonic chimeras are formed. On the prevalent view in the philosophical literature, it is said that chimeras are the product of two embryos that fuse to form a new third embryo. We call this version of fusion synthesis. In contrast to synthesis, we present an alternative mechanism for chimera formation called incorporation, wherein one embryo incorporates the cells of a second embryo into its body. We argue that the incorporation thesis explains (...) other types of chimera formation, which are better understood, and is more consistent than synthesis with what is known about embryological development. Incorporation also has different implications than synthesis and so avoids the philosophical puzzles that are often said to accompany embryonic chimera formation—puzzles which pose problems to the human embryo’s persistence from fertilization to the fetal stage of human development. A number of philosophers maintain that the destruction of an embryo in the first 2 weeks after fertilization is not morally problematic as it is metaphysically impossible for any human organism to then have existed. We contend that the typical adult human organism was once a zygote so there is no metaphysical shortcut to justify early abortion. We show that five arguments against human organisms ever having been zygotes fail. All of the arguments have to do with one variant or (...) another of the zygote or early embryo dividing. They do not provide any reason to believe that since some adult organisms are not identical to zygotes due to earlier divisions, none could have been. (shrink)

Three eminent scientists analyze the scientific, social, and political roots of biological determinism.

Is it coherent to be personally opposed to abortion but to accept others’ decisions to terminate their pregnancy? This might appear to be the case if one appeals to the different situations and attitudes of pregnant women. To the contrary, only those people whose personal opposition to abortion is restricted to situations in which the pregnancy and its consequences are not very burdensome can consistently hold their IPOB position and espouse an objective ethics. The vast majority of people claiming to (...) be merely personally opposed cannot coherently sustain that position. To be logically coherent, the latter not only must be committed to condemning the abortions of others and have the moral standing to do so, but more importantly and controversially, must be committed to call for a legal ban on abortion rather than restrict themselves to being merely personally opposed to abortion. One often hears Catholic and non-Catholic politicians and private citizens claim “I am personally opposed to abortion... ” but add that it is morally permissible for others to accept abortion. We consider a Rawlsian defense of this position based on the recognition that one’s opposition to abortion stems from acomprehensive doctrine which is incompatible with Public Reason. We examine a second defense of this position based upon respecting the autonomy of others and a third grounded in the harm to the (...) unwilling mother overriding that to the aborted fetus. We look at a fourth and fifth defense based upon our epistemic ignorance regarding the burdens on others of unwanted pregnancies and the ontological and moral status of embryo. We find most versions of these defenses to be wanting and conclude that only if the proponents of the position are subjectivist about morals, which few are, can they offer a coherent defense. During the first 16 days after fertilization, the developing embryo has the capacity to separate into two genetically identical embryos, or monozygotic twins (triplets, etc.). Because of this capacity, philosophers typically argue that the pre-16 day embryo is not a human being. On a Biological Account of Personal Identity (BAPI), which considers us human beings as essentially organisms, the development of the embryo into an organism at 16 (or 21) days marks our origins. The development of an embryo into an (...) organism is also said to mark the point at which the embryo loses its potential to give rise to monozygotic twins. This is considered a strength of the Biological account of our origins. I will argue here that it is the BAPI's own criteria that will have to allow cases of monozygotic twinning occurring even after 16 days, and that in virtue of this a Biological Account faces twinning puzzles usually reserved for earlier accounts of our origins. Epistemic pluralism is a form of pluralism whose object is knowledge, a sub- stantial component or prerequisite of knowledge, or a process of knowledge acquisition. It assumes that this target notion can be realised in not one, but many ways, and that this plurality is non-trivial.

In so far as the Tao Te Ching and the Chuang Tzu are life-philosophies, they are philosophies of solitude. My aim in the following pages is to explain and defend this claim, clarifying the distinctive kind of solitude that is taught by Lao Tzu and Chuang Tzu.

This paper critically evaluates an objection to introspective arguments for human freedom found within Spinoza's Ethics. The objection-- which we call Spinoza's dream argument -- challenges the evidentiary value of a person's experience of her own freedom by pointing out that some choices made within dreams are experienced as no less free than choices made while awake despite the fact that choices made within dreams are not free. After reconstructing Spinoza's dream argument, we critically evaluate it, concluding ultimately that it (...) fails in two respects. First, we draw upon the results of an experiment we conducted that suggests that dreamt choices are not experienced as free to the same extent as choices made while awake. Second, we argue that there is no compelling justification for the claim that choices made within dreams are not free. (shrink)

There remains a need to properly analyze the metaphysical assumptions underlying two organ procurement policies: presumed consent and organ sales. Our contention is that if one correctly understands the metaphysics of both the human body and material property, then it will turn out that while organ sales are illiberal, presumed consent is not. What we mean by illiberal includes violating rights of bodily integrity, property, or autonomy, as well as arguing for or against a policy in a manner that runs (...) afoul of Rawlsian public reason. Introduction While quizzing during informed consent for research to ensure understanding has become commonplace, it is unclear whether the quizzing itself is problematic for potential participants. In this study, we address this issue in a multinational HIV prevention research trial enrolling injection drug users in China and Thailand. Methods Enrolment procedures included an informed consent comprehension quiz. An informed consent survey followed. Results 525 participants completed the informed consent survey (Heng County, China=255, Xinjiang, China=229, Chiang Mai, Thailand=41). Mean age was (...) 33 and mean educational level was 8 yrs. While quizzing was felt to be a good way to determine if a person understands the nature of clinical trial participation (97%) and participants did not generally find the quiz to be problematic, minorities of respondents felt pressured (6%); anxious (5%); bored (5%); minded (5%); and did not find the questions easy (13%). In multivariate analysis, lower educational level was associated with not minding the quizzing (6–10 yrs vs 0–5 yrs: OR=0.27, p=0.03; more than 11 yrs vs 0–5 yrs: OR=0.18, p=0.03). There were also site differences (Heng County vs Xinjiang) in feeling anxious (OR=0.07; p=<0.01), not minding (OR=0.26; p=0.03), being bored (OR=0.25; p=0.01) and not finding the questions easy (OR=0.10; p=<0.01). Conclusions Quizzing during the informed consent process can be problematic for a minority of participants. These problems may be associated with the setting in which research takes place and educational level. Further research is needed to develop, test and implement alternative methods of ensuring comprehension of informed consent. Trial Registration clinicaltrials.gov number NCT00270257. (shrink)

Transplantation research on samples and organs from deceased donors in England, Wales and Northern Ireland is under threat. The key problems relate to difficulties encountered in gaining consent for research projects, as distinct from consent to donation for clinical transplantation. They are due partly to the terms of the Human Tissue Act 2004 (the 2004 Act), and partly to its interpretation by the Human Tissue Authority (HTA). They include excessive interaction with donor representatives regarding ‘informed consent’ to research projects, uncertainty (...) as to the scope and duration of a donor's ‘authority’ over an organ, and restrictions caused by the apparent need for licensing of transplantation research under the 2004 Act, combined with lack of certainty, or guidance, as to the distinction between ‘research’, which requires a licence, and ‘service development’, which does not. In our view this confusion hinders and deters Specialist Nurses for Organ Donation in approaching donor representatives and discussing possible research projects with them. It has also, as we have reported elsewhere, led to abandonment of research projects for fear of liability, despite both Research Ethics Committee (REC) approval and donor consent. Such problems do not seem to occur under the transplant laws of most other comparable jurisdictions. The Transplantation Ethics Symposium, ‘The ethics of organ retrieval: goals, rights and responsibilities’, hosted by the MRC Centre for Transplantation at King's College London in December 2010, revealed that many senior clinicians and researchers, administrators, and lawyers are both unclear and in disagreement concerning the effects of the 2004 Act and the extent to which it is adhered to or ignored in practice. In this paper we examine the difficulties encountered and suggest solutions based on a less restrictive interpretation of the 2004 Act, or, more probably, a regulatory change under its authority. We propose that, in the long term, a law which includes consent for REC-approved research within the general consent for organ donation and transplantation seems preferable to the present system, both ethically and in practical terms. The recent global pandemic has led to a shift to online conferences in philosophy. In this paper we argue that online conferences, more than a temporary replacement, should be considered a sustainable alternative to in-person conferences well into the future. We present three arguments for more online conferences, including their reduced impact on the environment, their enhanced accessibility for groups that are minorities in philosophy, and their lower financial burdens, especially important given likely future reductions in university budgets. We also (...) present results from two surveys of participants who attended one large and three small online philosophy conferences this year. We show that participants were in general very satisfied with presentations and discussions at the conferences, and that they reported greater accessibility. This indicates that online conferences can serve as a good alternative to in-person conferences. We also find that networking was less satisfactory in online conferences, indicating a point for improvement and further research. In general, we conclude that philosophers should continue to organize online conferences after the pandemic. We also provide some advice for those wishing to organize online conferences. (shrink)

Laws requiring autopsies have generated little controversy. Yet it is considered unconscionable to take organs without consent for transplantation. We think an organ draft is justified if mandatory autopsies are. We reject the following five attempts to show why a mandatory autopsy policy is legitimate, but organ conscription is not: (1) The social contract gives the state a greater duty to protect its citizens from each other than from disease. (2) There is a greater moral obligation to prevent murders than (...) disease-caused deaths because killing people is morally worse than allowing people to die. (3) Autopsies do not confiscate body parts, but organ transplants do. (4) The citizenry's knowledge that their organs are very likely to be taken will generate more anxiety than the remote possibility of a mandatory autopsy. (5) A religious conviction that one's organs will be needed in order to be resurrected is threatened by organ transplantation but not by autopsies that "return" body parts. (shrink)

What causes adolescents to develop consumer’ ethical beliefs? Prior research has largely focused on the negative influence of peers and negative patterns of parent–child interactions to explain risky and unethical consumer behaviors. We take a different perspective by focusing on the positive support of parents and peers in adolescent social development. An integrative model is developed that links parental and peer support with adolescents’ self-worth motives, their materialistic tendencies, and their consumer ethical beliefs. In a study of 984 adolescents, we (...) demonstrate support for a sequential mediation model in which peer and parental support is positively related to adolescents’ self-esteem and feelings of power, which are each associated with decreased materialism as a means of compensating for low self-worth. This reduced materialism is, in turn, associated with more ethical consumer beliefs. (shrink)

Marketing research on adolescents’ ethical predispositions and risky behaviors has focused primarily on individual difference variables. The present study, in contrast, examines the social network positions that an adolescent occupies within a group. A survey of 984 adolescents demonstrates that EP and RB stem from a balance between assimilation and individuation. In particular, we show that adolescents with close first-degree relationships within a specific peer group and/or high need for uniqueness have lower EP and engage in more RB, while adolescents (...) that are more central to the entire network have higher EP.
